Terms of Service

These Terms of Service ("Terms") govern your use of the the90th mobile application and the website the90th.io (collectively, the "Service"), operated by Alimcosoft ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you are at least 13 years old. If you are under the age of majority in your jurisdiction, you must have the consent of a parent or legal guardian to use the Service.

2. Account Registration

To access certain features of the Service (including predictions, chat, and leagues), you must create an account using either:

• Google OAuth sign-in
• Email and password

You agree to:

• Provide accurate and complete information when creating your account
• Maintain the security of your account credentials and not share them with others
• Notify us immediately if you suspect unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

3. Guest Access

You may browse certain parts of the Service (such as live scores and match information) without creating an account. However, features that involve user-generated content (predictions, chat, leagues, watch parties, and player ratings) require an account.

4. Subscriptions and Payments

4.1 Premium Subscription

The90th offers a premium subscription ("the90th Premium") that provides additional features including bonus prediction categories, unlimited private leagues, increased chat rate limits, custom flair, and an ad-free experience.

4.2 Pricing

Premium is available at the following price points:

• Monthly: $2.49 per month
• Lifetime: $9.99 one-time purchase

Prices are in US dollars and may vary by region as determined by Google Play or the Apple App Store. Prices are subject to change with notice.

4.3 Payment Processing

All subscription purchases are processed through Google Play or the Apple App Store (collectively, the "App Stores") and managed via RevenueCat. We do not directly process, store, or have access to your payment card or billing details. Your purchase is subject to the respective App Store's terms and conditions.

4.4 Cancellation and Refunds

You may cancel your monthly subscription at any time through the App Store where you made the purchase. Upon cancellation:

• Your premium access continues until the end of your current billing period
• No refunds are provided for partial billing periods
• You will revert to the free tier once your current period expires

Lifetime purchases are non-refundable except as required by applicable law or App Store refund policies. To request a refund, contact the App Store where you made the purchase.

5. User Conduct

You agree not to use the Service to:

• Post or transmit content that is hateful, threatening, abusive, defamatory, obscene, or otherwise objectionable
• Harass, bully, intimidate, or threaten other users
• Spam, flood, or disrupt chat channels with repetitive or irrelevant messages
• Impersonate another person, team, organization, or entity
• Post content that promotes violence, discrimination, or illegal activity
• Attempt to manipulate predictions, scores, leaderboards, or any other game mechanics
• Create multiple accounts to circumvent bans, rate limits, or league restrictions
• Use automated tools, bots, or scripts to interact with the Service
• Attempt to access, tamper with, or reverse-engineer any part of the Service or its infrastructure
• Collect or harvest personal information of other users
• Use the Service for any commercial purpose not authorized by us

We reserve the right to moderate, remove, or restrict any content that violates these Terms, and to suspend or ban users who repeatedly violate our rules.

6. User-Generated Content

You retain ownership of the content you create on the Service, including your predictions, chat messages, player ratings, poll votes, and watch party listings.

By posting content on the Service, you grant Alimcosoft a worldwide, non-exclusive, royalty-free, transferable license to use, display, reproduce, and distribute your content solely in connection with operating, providing, and improving the Service. This license ends when you delete your content or your account, except for content that has been shared with or viewed by other users (such as chat messages that other users have already seen).

You are responsible for the content you post. You represent that you have all necessary rights to post your content and that it does not violate any law or infringe any third-party rights.

7. Prediction Game

The prediction game on the90th is for entertainment purposes only. It is not gambling, betting, or wagering in any form. No real money, prizes, or anything of monetary value is awarded based on prediction accuracy. Points, leaderboard rankings, and badges are virtual and have no cash value.

Users make their own predictions based on their own judgment. The Service does not use artificial intelligence to make predictions on behalf of users, nor does it provide betting advice or tips.

8. Intellectual Property

The "the90th" name, logo, branding, and all original content, features, and functionality of the Service are owned by Alimcosoft and are protected by applicable intellectual property laws.

"FIFA," "World Cup," and related marks and logos are trademarks of the Federation Internationale de Football Association (FIFA). The90th is an independent fan application and is not affiliated with, endorsed by, or sponsored by FIFA or any national football association.

Team names, player names, and logos displayed within the app are the property of their respective owners and are used for informational purposes.

9. Termination

We may suspend, restrict, or terminate your account and access to the Service at our sole discretion, with or without notice, for reasons including but not limited to:

• Violation of these Terms of Service
• Repeated reports from other users (accounts are auto-flagged after 5 reports)
• Engaging in abusive, fraudulent, or illegal behavior
• Extended periods of inactivity (with prior notice)

You may delete your account at any time through the app (Settings > Delete Account) or by emailing alimcosoft@gmail.com. Upon account deletion, your data will be handled as described in our Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• Live scores, match data, or statistics will be accurate or up-to-date at all times
• Any defects in the Service will be corrected
• The Service will meet your specific requirements or expectations

Match data and live scores are sourced from third-party providers and may experience delays or inaccuracies. We are not responsible for the accuracy of third-party data.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALIMCOSOFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR TEN DOLLARS ($10.00), WHICHEVER IS GREATER.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Alimcosoft operates, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the Service shall be resolved in the courts of competent jurisdiction.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Effective date" at the top of this page
• Notify users through the app via an in-app notification

Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Service and delete your account.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
